These Terms and Conditions ("Terms") govern your use of the Complete Encinitas Fence Builder website at encinitasfencebuilder.com and any services you engage us to perform. By using this website or hiring us for fence work, you agree to these Terms. Please read them carefully before proceeding.
By accessing or using this website, requesting an estimate, or entering into a service agreement with Complete Encinitas Fence Builder, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use this website or engage our services.
Complete Encinitas Fence Builder provides residential and commercial fence installation, repair, replacement, and related services in Encinitas, CA and surrounding communities. The specific scope of work for any project is defined in the written estimate or contract provided to you before work begins.
We reserve the right to decline any project at our sole discretion. Acceptance of an estimate does not guarantee availability; project scheduling is confirmed separately and subject to our current workload and conditions at the time of scheduling.
All estimates provided by Complete Encinitas Fence Builder are based on information available at the time of the site visit or inquiry. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
If site conditions differ materially from what was observed during the estimate - such as buried obstacles, soil conditions that require additional materials, or discrepancies in the fence line length - we will notify you before proceeding and discuss any price adjustment. We will not perform additional work beyond the original scope without your prior approval.
Permit fees, utility marking fees, and HOA submission costs, if applicable, are either included in your written estimate or disclosed separately before work begins.
Scheduled installation dates are confirmed in writing or by phone. We will make reasonable efforts to meet the agreed schedule. We reserve the right to reschedule due to weather, permit delays, material availability, or other circumstances beyond our control. We will notify you as early as possible if a rescheduling is necessary.
If you need to cancel or reschedule, please notify us at least 48 hours before the scheduled start date. Cancellations with less than 48 hours notice may result in a cancellation fee as specified in your written contract.
If you cancel a project after materials have been ordered or fabricated specifically for your job, you may be responsible for restocking fees or the cost of non-returnable materials.
Payment terms are specified in your written contract or estimate. Unless otherwise agreed in writing, payment is due in full upon completion of the project. For larger projects, we may require a deposit before work begins; deposit amounts and conditions will be disclosed in your estimate.
Accepted payment methods will be communicated to you before or at the time of estimate. Payments not received within the agreed timeframe may be subject to late fees as allowed under California law.
If payment is not received and collection action becomes necessary, you agree to be responsible for reasonable collection costs, including attorney fees, to the extent permitted by applicable law.
You agree to provide accurate information about your property, including fence line location, HOA status, and any known underground utilities. You are responsible for obtaining HOA approval where required before work begins. While we will advise you on city permit requirements and handle the permit application on your behalf where agreed, you are responsible for ensuring your property is eligible for the proposed work under applicable local rules.
You are responsible for clearing the fence line of plants, furniture, stored items, and ensuring pets and children are kept away from the work area during installation.
We stand behind our workmanship. Any specific warranty terms applicable to your project will be stated in your written contract. Where no written warranty terms are specified, we warrant our labor against defects in workmanship for a period of one year from the date of project completion.
Warranties on materials are provided by the material manufacturer and are separate from our labor warranty. We will assist you in communicating with manufacturers regarding defective materials where applicable.
Our warranty does not cover damage caused by misuse, vandalism, acts of nature, vehicle impact, improper customer maintenance, or modifications made to the fence by anyone other than Complete Encinitas Fence Builder after project completion.
To the fullest extent permitted by law, Complete Encinitas Fence Builder is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of this website or from services provided under any contract, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from services provided shall not exceed the total amount you paid us for the specific project giving rise to that claim.

If a dispute cannot be resolved through direct communication, both parties agree to attempt good-faith mediation before pursuing formal legal action. Any unresolved disputes shall be subject to the jurisdiction of the courts in San Diego County, California.
These Terms and any disputes arising from your use of this website or from services provided by Complete Encinitas Fence Builder are governed by the laws of the State of California, without regard to conflict of law principles. Any legal proceedings shall be brought exclusively in the courts of San Diego County, California.
